In a January lawsuit filed against the superstar rapper/actor and Treyball Studios Management, a judge has dismissed a sexual harassment and wrongful termination vs Will Smith.
According to the suit filed in the Superior Court of California, violinist Brian King Joseph claimed that he was wrongfully terminated from his job as a musician on the Based on a True Story tour after reporting an incident in Las Vegas in March 2025. The plaintiff alleged that someone had left a “sexual message”, wipes, a beer bottle, HIV medication with someone else’s name on it, and hospital discharge paperwork in his hotel room one day.
Declaring that the note did not meet the requirements of sexual misconduct in the workplace, Judge Michael Shultz dismissed the case in a court order, stating:
“The allegations do not support a severe and pervasive concerted pattern of harassment sufficient to create an abusive working environment,” adding that Joseph did not prove that he was dismissed as a result of reporting “something improper in the workplace.”
Representatives for the 57-year old Smith, and his production company previously denied allegations in the lawsuit, stating “Mr. Joseph’s allegations concerning my client are false, baseless, and reckless.” “They are categorically denied, and we will use all legal means available to address these claims and to ensure that the truth is brought to light.”
